The case of Baker v Osborne was an accident that happened in May of 2007 outside of Modesto. Mr, Baker a construction supervisor suffered 8 fractured ribs and spent 5 days in the hospital and several months trying to get over the immediate affects of the injuries.
Mercury Insurance the opposing carrier had a policy of $250,000.00 that they refused to cough up despite the initial hospitalization being billed at over $150,000.00 with only 80,000.00 being actually paid. Four weeks before trial was to begin Mercury finally disclosed that there was an excess carrier by the name of Navigator Insurance.
Two weeks before trial was to begin in Modesto, California the case was settled for $315,000.00 with Mercury finally coughing up it’s $250,000.00 and Navigator kicking in another $65,000.00. This is typical action of Mercury to refuse to pay until facing a jury and then sometimes refusing to acknowledge what the jury finds and appealing for the sole purpose of delaying payment
